Digital Products Terms

Last updated: 28 October 2026

1. Introduction

These Digital Products Terms govern purchases of digital products offered by TRENDSTUDIO and TRENDSTUDIO Intelligence.

TRENDSTUDIO is the trading name of Sonia Vega-Pérez, a sole trader operating in the United Kingdom.

These Terms apply to individual consumers and business customers, subject to applicable law and any product-specific conditions disclosed before purchase.

They should be read alongside our General Terms & Conditions and Privacy Policy.

2. Our digital products

TRENDSTUDIO develops strategic intelligence products, which may include:

  • AI-generated brand audits and diagnostic reports.

  • Cultural, consumer and market research.

  • Competitive analysis and positioning reports.

  • Strategic frameworks and templates.

  • Downloadable documents and research resources.

  • Digital tools and other products introduced in the future.

The relevant product page describes the product's features, scope, format, price and delivery arrangements.

Additional conditions may apply to particular products where clearly disclosed before purchase.

3. Who can purchase

Our digital products are available to individual consumers and business customers, subject to any geographic or product-specific restrictions.

You must be at least 18 years old to purchase.

If purchasing on behalf of an organisation, you confirm that you have authority to act for it.

A consumer is generally someone acting for purposes wholly or mainly outside their trade, business, craft or profession. A purchase made in an individual's name may still be a business purchase if primarily made for professional purposes.

4. Product information

Before purchase, we will provide information about the product's main characteristics, price, delivery arrangements and material limitations.

Depending on the product, this may include:

  • Required customer inputs.

  • Research scope and methodology.

  • File formats or technical requirements.

  • Access arrangements.

  • Estimated delivery times, where provided.

  • Whether human review is included.

  • Applicable cancellation and refund information.

You should review this information before placing an order.

5. Pricing, payments and merchant of record

Prices are displayed in the currency shown at checkout.

Applicable taxes and additional charges will be disclosed in accordance with applicable law.

Payments are processed through authorised payment providers, including Stripe.

For standard TRENDSTUDIO transactions, Sonia Vega-Pérez trading as TRENDSTUDIO is the seller.

For eligible transactions processed through Stripe Managed Payments, the merchant of record is the entity identified during checkout. That entity's transaction terms, tax arrangements and payment-related policies may also apply.

The merchant-of-record identity shown at checkout and in the transaction confirmation determines the relevant payment arrangements.

TRENDSTUDIO remains responsible for the product-related obligations it undertakes, subject to applicable contractual arrangements and law.

We do not store complete payment card details on our own systems.

6. Accounts and purchase access

Certain products require a TRENDSTUDIO Intelligence account.

Following successful payment verification, the relevant product or entitlement will be associated with your customer account.

You may need to create an account or sign in using the email associated with your purchase.

Access is granted only after the necessary payment and entitlement checks have been completed.

Unless expressly included in the product description, a purchase grants access to one product or one generation entitlement, not unlimited repeated use.

7. Customer inputs

Some products require information from you before production can begin.

For the Brand Distinction Audit, this may include a brand name, website address, market scope and competitor preferences.

You agree to provide accurate information to the best of your knowledge and to submit only information you are entitled to provide.

You must not submit unlawful material, malicious content or confidential or personal information that you lack authority to disclose.

Incomplete or inaccurate inputs may affect the relevance or quality of the resulting product.

8. AI-generated research

The Brand Distinction Audit is an AI-generated strategic research product.

It uses automated information retrieval, analysis and interpretation to assess brand positioning, competitive distinction and related strategic considerations.

Its findings may combine:

  • Publicly available information.

  • Automated source extraction.

  • Comparative analysis.

  • Qualitative strategic interpretation.

  • AI-generated observations and recommendations.

We aim to identify relevant sources, distinguish evidence from interpretation and disclose material limitations.

However, publicly available information may be incomplete, outdated or inconsistent, and automated systems may produce errors.

Unless expressly stated on the product page, the Brand Distinction Audit does not include individual human consultant review or approval before delivery.

Future products may use different research methods or levels of human involvement, as described in their product information.

9. Delivery

Digital products may be supplied through a customer dashboard, downloadable file, email notification or another stated method.

For products requiring customer inputs, generation may begin only after those inputs have been submitted and the necessary payment or account checks completed.

Any estimated delivery time is indicative unless expressly guaranteed.

We will take reasonable steps to address technical failures or material delays.

Where a product cannot be supplied within the agreed or legally required timeframe, applicable cancellation, refund and other remedies will be respected.

Customers should retain permitted downloaded copies. Indefinite hosting or permanent access is not guaranteed unless expressly included in the product description.

10. Consumer cancellation rights

If you purchase as a consumer, you may have a statutory right to cancel an online purchase within 14 days, subject to applicable legal exceptions.

The applicable rules depend on the nature of the product, including whether it is legally classified as digital content or a digital service.

Digital content

For digital content not supplied on a tangible medium, we will not begin supply within the statutory cancellation period unless we have obtained any express consent and acknowledgement required by applicable law.

Where the relevant legal requirements are satisfied, the statutory cancellation right may be lost once supply of the digital content begins.

For UK consumer purchases, this generally requires your express consent to supply beginning during the cancellation period and your acknowledgement that you will lose the statutory right to cancel once supply begins. The required confirmation must also be provided on a durable medium.

The completion of an internal processing step, the generation of a report and the making available of a finished product are not automatically interchangeable for legal purposes.

Brand Distinction Audit

The Brand Distinction Audit is generated following purchase and submission of the required brand information.

Before any step that constitutes the beginning of digital-content supply during an applicable cancellation period, we will obtain the legally required consent and acknowledgement.

If you have a statutory cancellation right and validly cancel before that right has expired or been lawfully lost, we will provide the refund required by applicable law.

Digital services

Some future products may constitute digital services or other services rather than digital content.

Where different cancellation rules apply, including rules concerning early performance or completed services, those rules will be explained and followed.

Exercising cancellation rights

Where you have a right to cancel, you may exercise it by emailing:

info@ts-trendstudio.com

Please include your name, purchase email and order reference where available.

You may use the model cancellation form at the end of these Terms, but you are not required to do so.

Where a third-party merchant of record handles the transaction, its designated cancellation or refund process may also be available.

Nothing in these Terms removes statutory rights that cannot lawfully be excluded.

11. Refunds and product problems

We aim to provide digital products that match their descriptions and meet applicable legal requirements.

If you experience a problem, contact info@ts-trendstudio.com with your order reference and a description of the issue.

Depending on the circumstances and applicable law, remedies may include:

  • Restoring access.

  • Correcting a technical problem.

  • Re-supplying the product.

  • Providing an appropriate price reduction.

  • Issuing a partial or full refund.

A change of mind after a cancellation right has lawfully expired or been lost does not automatically create an additional contractual refund entitlement.

We may nevertheless consider discretionary refunds where appropriate.

Nothing in these Terms excludes statutory remedies for faulty, misdescribed or non-conforming digital content or services.

Where Stripe Managed Payments is the merchant of record, transaction refunds may be administered by the relevant provider. Customers may still contact TRENDSTUDIO about product-related issues.

12. Intellectual property and permitted use

Unless otherwise stated, TRENDSTUDIO retains ownership of its original methodologies, report structures, analytical frameworks, written commentary, software and other proprietary materials.

Following purchase and lawful delivery, you receive a non-exclusive, non-transferable licence to use the product for your own personal purposes or your organisation's internal business purposes, as applicable.

Subject to product-specific conditions, you may:

  • Read and use the product.

  • Download and retain permitted copies.

  • Share findings internally within your organisation.

  • Use the analysis to inform your own decisions.

Unless expressly authorised, you may not:

  • Resell or commercially redistribute the product.

  • Publish substantial portions as a standalone resource.

  • Repackage the product as your own commercial research offering.

  • Remove proprietary notices.

  • Misrepresent TRENDSTUDIO's original analysis as independently produced research.

You remain free to use general ideas, knowledge and conclusions gained from the product, subject to applicable intellectual property law and third-party rights.

Broader distribution or commercial licensing requires separate permission.

13. Third-party materials

Products may reference third-party brands, trademarks, websites, products, images and publicly available materials for research, commentary and comparative analysis.

Such references do not imply affiliation, sponsorship or endorsement.

Third-party intellectual property remains with its respective owners.

A product purchase does not transfer ownership of third-party materials or grant rights beyond those lawfully available.

Where a product includes third-party images or other protected material, the permitted uses of that material may be more limited than the permitted uses of TRENDSTUDIO's original analysis.

14. Customer materials and brand imagery

You retain your rights in original information and materials you submit.

You grant TRENDSTUDIO permission to process those materials as reasonably necessary to generate, deliver, maintain and support your purchased product, subject to applicable law and our Privacy Policy.

Where you request an audit of a brand you own or are authorised to represent, you authorise TRENDSTUDIO to use that brand's publicly available imagery and materials within your private report to the extent that you have the legal authority to grant such permission.

You confirm that any permissions you grant are within your authority.

Where you request an audit of a third-party brand you do not own or represent, you do not purport to grant rights over that brand's intellectual property.

TRENDSTUDIO remains responsible for assessing its own lawful basis for retrieving, analysing or reproducing third-party materials.

This clause does not authorise public publication of customer reports, brand imagery or confidential information without an appropriate legal basis or permission.

15. Confidentiality

We handle customer information in accordance with our Privacy Policy and applicable law.

Standard automated products do not automatically include a separately negotiated non-disclosure agreement.

If you require bespoke confidentiality arrangements or enhanced restrictions on information processing, contact us before submitting sensitive information.

16. Accuracy and professional judgement

TRENDSTUDIO products are intended to support strategic analysis and informed decision-making.

They do not guarantee commercial performance, revenue growth, competitive advantage or particular business outcomes.

Research and strategic interpretation depend on available evidence, analytical assumptions and changing market conditions.

You remain responsible for evaluating recommendations and deciding how to use them.

Our products do not constitute legal, financial, investment or other regulated professional advice.

17. Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or rights and remedies that consumers cannot legally waive.

For consumer purchases, we are responsible for losses recoverable under applicable law, including foreseeable loss or damage resulting from our breach of contract or failure to exercise reasonable care and skill.

For business purchases, to the extent permitted by law, we exclude liability for indirect or consequential commercial losses, lost profits, lost business opportunities and anticipated savings arising from use of strategic interpretations or recommendations.

For business customers, our aggregate contractual liability arising from a particular digital product is limited to the amount paid for that product, except where such a limitation would be unlawful or unenforceable.

These limitations are subject to applicable law and any mandatory rules governing contractual fairness and reasonableness.

18. Future products and changes

We may introduce new digital products, formats, access models or functionality.

Product-specific conditions may apply where clearly disclosed before purchase.

We will not materially reduce the essential characteristics of a product already purchased without an appropriate legal basis or remedy.

Subscriptions, ongoing digital services or bespoke consulting engagements may be governed by additional terms.

19. Support and complaints

For technical problems, product enquiries, complaints or refund requests, contact:

info@ts-trendstudio.com

Please include your order reference and relevant details where available.

We will review complaints fairly and respond within a reasonable timeframe.

Where a third-party merchant of record handles payment-related support, you may also use the contact details provided in your transaction confirmation.

20. Governing law and jurisdiction

These Terms are governed by the laws of England and Wales.

For consumers, this does not remove mandatory consumer protections applicable in their country of habitual residence where those protections apply.

Consumers may have rights to bring proceedings in other competent courts under applicable law.

For business customers, the courts of England and Wales will have jurisdiction over disputes arising from these Terms, subject to mandatory legal requirements.

21. Changes to these Terms

We may update these Terms to reflect changes in our products, operations or legal requirements.

The version applicable to a purchase will generally be the version presented at the time of that purchase, unless a later change is validly agreed or required by law.
